Named-Prescriber Enforcement Forborne
DOPL forgoes unlawful-conduct and unprofessional-conduct enforcement under §58-1-501(1)-(2) and related professional-licensing provisions against any provider who (1) acts solely as the named prescriber for AI-authorized renewals, (2) does not interact directly with a patient or other provider, and (3) complies with the RMA terms. Forbearance applies only to conduct authorized by the agreement.
What Counts
- Provider's role is limited to being the named prescriber for AI-generated renewal
- Provider does not interact directly with the patient or another provider in the renewal chain
- Provider acts in reliance on the participant's AI technology
- Provider abides by the terms of the RMA and any separate agreement with the participant
- Forbearance also covers 58-31b / 58-60 / 58-61 / 58-67 / 58-68 / 58-70a professional-conduct provisions as specified in the agreement
What Does Not Count
- Providers who interact directly with patients or other providers
- Conduct beyond the authorized renewal workflow
- Conduct inconsistent with agreement terms
- Enforcement under statutes not enumerated in the agreement's mitigation section
