An RMA participant may not reference the existence of the agreement in advertising, media, or promotional materials. The mitigation is a regulatory posture, not a marketable endorsement by the State of Utah.
What Counts
- No mention of the RMA in paid advertising
- No mention in press releases, media appearances, or promotional content
- No implication that OAIP or the State has endorsed or approved the participant's product or service
What Does Not Count
- Neutral disclosure to regulators, investors, or counterparties in business documents
- Factual references in required legal disclosures where non-disclosure is not practicable
